HomeManaged Divorce and Clean Break Order

Managed Divorce and Clean Break Order

An experienced solicitor prepares all of the divorce paperwork and corresponds with the court on your behalf.  They will also draft a simple clean break order for you and your spouse to sign before filing it at the court.

Who is it suitable for?

You should choose this service if you want your entire divorce managed by one of our in-house solicitors at a fraction of the cost of using a traditional high-street solicitor.  You will have reached agreement with your spouse regarding the grounds of the divorce and have few (if any) marital assets to divide.

The clean break order provides you with security and peace of mind.  It is a legally binding agreement which prevents you or your spouse from making a financial claim against one another at a later date.

If you have more complex financial assets such as a pension and/or you have agreed upon spousal maintenance payments, you will need the Managed Divorce and Consent Order Service instead.

How does it work?

You complete a straightforward questionnaire and we will prepare the initial divorce petition within 48 hours.

You complete a questionnaire on the agreement you have reached with your ex-spouse regarding the division of the marital assets.

You will receive regular updates from our dedicated support team..

How does it work

You complete a straightforward questionnaire and we prepare the initial divorce petition within 48 hours. We deal with all correspondence to the court and any third parties.  We also prepare the applications for decree nisi and the decree absolute. Please note court fees are payable prior to the filing of the petition , this is currently set by the UK courts at £550 for the divorce and £50 for an application by consent for a financial order. These fees are payable to us by bank transfer when the solicitor drafted applications have been approved by yourself. The fees will be paid directly to the court at the time of filing by ExD Legal Services.

In addition, you will complete a questionnaire on the agreement you have reached with your ex-spouse regarding your clean break agreement.  This will enable our solicitor to prepare a draft order for your consideration.  If necessary, we will contact you for further details.

Depending on individual circumstances, we normally like to submit the clean break order to the court soon after you receive the decree nisi which is approximately halfway through the divorce process.

Although we will regularly update you by email on the progress of your divorce, we will also update you if there are any unexpected delays to your divorce and investigate on your behalf.

You would normally expect to receive your decree absolute and approved clean break order within 24 – 28 weeks.
